The Trial Journal of the Illinois Trial Lawyers Association has published an article authored by Rapoport Weisberg & Sims P.C. partner Joshua L. Weisberg called ” Bausch v. Stryker Corp.: A Major Victory for Plaintiffs in Medical Device Cases.” In Bausch, the Seventh Circuit held that a woman injured by a defective medical device that was granted premarket approval by the FDA has the right to sue the manufacturer of the device on the basis that the device was built in violation of federal safety laws. Mr. Weisberg, who argued the case in the Seventh Circuit, explained after the court’s favorable decision, “People who suffer harm from defective medical devices manufactured in violation of federal regulations should have remedies in court not only because this is fair, but also because it makes us all safer.”
