Rapoport Weisberg & Sims P.C. obtained a $450,000 motor vehicle negligence lawsuit settlement today on behalf of a 20-year-old college student who sustained a fractured left femur in an auto accident in Fitchburg on January 29, 2006. The auto accident occurred after a drunk driver disregarded a red left turn signal and violently crashed his 2001 Pontiac Grand Am into the 1996 Honda Civic in which the student was a front seated passenger. The student, who was also a star pitcher on his college baseball team, underwent emergency surgery requiring an intramedullary rod to be inserted into his left femur, ending his baseball career. On behalf of the student, lead trial attorney Joshua L. Weisberg brought motor vehicle negligence and punitive damages claims against the drunk driver, whose blood alcohol content was measured to be .258 an hour after the crash, over three times the legal limit.
