On May 23, 2023, following a two week trial, a Winnebago County jury returned a unanimous verdict in favor of Rapoport Weisberg Sims & VanOverloop’s client in the amount of $4,000,000.00 for the wrongful death of a 51-year-old woman due to medical malpractice.
Trial attorneys Joshua L. Weisberg and Melanie J. VanOverloop of Rapoport Weisberg Sims & VanOverloop filed the lawsuit on behalf of the woman’s family and estate and represented them at trial. A summary of the case can be foundhere.
Following the trial, the defendants filed a post-trial motion, followed by an appeal to the Appellate Court of Illinois, Fourth District, followed by a Petition for Leave to Appeal to the Supreme Court of Illinois. Each step of the way,Rapoport Weisberg Sims & VanOverloopdefeated the defendants’ attempts to overturn the jury’s verdict. In the meantime, significant pre-judgment and post-judgment accrued on top of the $4,000,000.00 verdict, resulting in a total recovery in excess of $5,200,000.00, which the Defendants have now ultimately paid.
After the Supreme Court denied the defendants’ final attempt to overturn the verdict, Mr. Weisberg stated, “We are proud that we had the privilege of representing this wonderful family and defeating every attempt by the defendants to evade responsibility for their wrongful conduct.
