Rapoport Weisberg & Sims P.C. recently obtained a $450,000 settlement on behalf of a 44 year old woman who sustained a lower back injury in an auto accident in DeKalb County, Illinois.
The accident occurred on January 18, 2013 when the woman was slowing down to take a right turn into a parking lot when she was rear-ended by another vehicle. After being in pain for five days, the woman went to the Hospital and was diagnosed with a lumbar back injury. After several years of treatment she eventually underwent a lumbar fusion surgery at L5-S1.
The driver’s insurer contested liability and claimed that Rapoport Weisberg & Sims P.C. client came to a sudden stop causing the collision, and it also challenged whether the woman’s back injury was related to the accident or a pre-existing spine condition. The defendant’s insurer also failed to initially disclose all of the available insurance coverage. However, ultimately, the attorneys at Rapoport Weisberg & Sims P.C. led by lead trial attorney Joshua L. Weisberg were able to discover the available insurance coverage and overcome the insurer’s defenses to achieve this settlement.
