Rapoport Weisberg & Sims P.C. has filed a products liability and negligence lawsuit against the manufacturer and designer of an electric motorcycle that catastrophically failed while a stunt performer was using the motorcycle for its intended purpose. The lawsuit alleges the defective design and manufacturing of the motorcycle frame caused it to crack into pieces, throwing its rider to the ground. According to the lawsuit, the manufacturer knew that the riders would need motorcycles for use in stunts and, after watching a demonstration of the stunts, guaranteed their motorcycles would be appropriate for use.
The rider, a four-time motocross national champion who was recently married and planning to start a family with her x-games champion husband, sustained a devastating spinal cord and brain injury. Also named as a defendant in the lawsuit is the company responsible for the purchase and maintenance of the electric motorcycle which failed to properly test the motorcycles or inspect the frame for fatigue prior to the frame failure.
The lawsuit seeks compensation for medical bills, lost wages, pain and suffering, and permanent disability.
