Last October, Rapoport Weisberg Sims & VanOverloop went to trial in the Circuit Court of DuPage County, Illinois, against the City of Elmhurst to recover damages on behalf of a man who sustained a fractured femur and also claimed injuries to his back after falling 16 feet from a forklift. Shortly before trial, the City admitted its negligence caused the plaintiff’s injuries, but the City disputed the nature and extent of the plaintiff’s injuries and the amount of damages he was seeking. The City’s highest pretrial settlement offer was $650,000.
On October 5, 2012 the unanimous jury returned a verdict in favor of the plaintiff for $4,160,000. The case has now been settled for $4,192,665, which includes the entire verdict amount plus post-judgment interest. The case was tried by Joshua L. Weisberg and Michael L. Teich.
