Comair plaintiff Jamie Hebert could likely be the first person to litigate a loss of consortium claim in the state of Kentucky.
A recent decision by U.S. District Court Judge Karl S. Forrester reinstated Ms. Hebert’s loss of consortium claim against Comair. Ms Hebert lost her husband, Bryan Keith Woodward, in the August 27, 2006 airplane crash of Comair Flight 5191 in Lexington, Kentucky. The reinstatement of Ms. Hebert’s claim comes as a result of the Kentucky Supreme Court’s ruling that surviving spouses are allowed to sue for the loss of consortium of a spouse wrongfully killed.
