Document: FINDINGS OF FACT & CONCLUSIONS OF LAW
Following a bench trial, the Honorable Joe Billy McDade of the U.S. District Court for the Central District of Illinois entered a judgment today in the amount of $2,251,954.71 in favor of the estate of a 76-year-old man killed after a United States mail carrier rear-ended the riding lawn tractor he was driving on a rural road in Anchor, Illinois, on April 30, 2007. Specifically, the Court awarded wrongful death damages for loss of society to the decedent’s widow and two adult children totaling $2,750,000, plus $63,943.39 in medical expenses, which was reduced by 20 percent due to contributory fault by the decedent. The decedent’s estate was represented at trial by Michael L. Teich and Joshua L. Weisberg of Rapoport Weisberg & Sims P.C. The judgment greatly exceeds the offer the United States made to settle the wrongful death case prior to trial. A copy of the Court’s decision is attached.
