Rapoport Weisberg & Sims P.C. has reached a confidential settlement in a medical malpractice case brought on behalf of a 44-year-old man from Rockford, Illinois. According to the complaint filed in Winnebago County, Rapoport Weisberg & Sims P.C.’s client was taken to the defendant’s immediate care facility for treatment of severe right foot and ankle pain shortly after falling off a roof while at work. Defendant ordered foot and ankle X-rays, but allegedly did not have a radiologist review them and misinterpreted the X-rays as normal when in fact they showed a fractured calcaneus (heel bone). Defendant allegedly misdiagnosed the man with a sprained ankle and treated him as if he had a sprained ankle for over two months before finally realizing he had a fractured calcaneus. The lawsuit alleged that as a result of this misdiagnosis and mistreatment, the injury was aggravated requiring the man to undergo several surgeries and resulting in permanent pain and disability.
